Elly Mariani is a researcher with the Department of Philanthropic Studies of the VU University Amsterdam. She is also a tax lawyer, specialized in estate planning with a focus on the legal and fiscal framework of charitable organisations. Elly is currently writing a dissertation on the tax treatment of contributions to charitable organisations in The Netherlands.
As in Australia, the Dutch government is planning to review and redesign nonprofit regulation via the introduction of the Gift Act. Although not yet definate, the new Act could contain:
- a redefinition of qualifying organisations
- the introduction of formal regulation of nonprofit organisations, and
- changes in the tax incentives.
The new Act also provides us with a blank canvas on which to improve current regulation. Thus, favourably shaping the communities incentives for charitable giving.
